Why & Where Do I Need to Be Compliant?
The purpose of OREC's marketing compliance guidelines is to protect the public from any illegal, bad-faith, offensive, etc. marketing efforts, AND to make all marketing clearly indicate to OREC AND the public which brokerage the agent is licensed with in case of a complaint. KW Elite's own guidelines may be more strict than OREC's in order maintain Keller Williams brand continuity, and to make sure agents are well-within the guidelines set forth by OREC. The purpose of this page is to educate Keller Williams Realty Elite associates on making all of their marketing efforts compliant with OREC, KWRI, and KW Elite's guidelines.
RULE OF THUMB
An agent's marketing (print, online, social media, etc.) should ALWAYS...
1. Make it EXTREMELY clear that they are an agent licensed with Keller Williams Realty Elite, and...
2. WHERE KW Elite can be contacted in case there is an issue/complaint with the agent's marketing.
ACKNOWLEDGEMENT OF COMPLIANCE REQUIREMENTS
- Agents must acknowledge the guidelines set forth on this page, AND register ALL of their online & social media marketing outlets with KW Elite using the Acknowledgement Form linked on this page.
- Agents must notify KW Elite of new online or social media outlets for marketing compliance review with the Marketing Approval Request Form.
- It is each agent’s own responsibility to be compliant with the guidelines on this page. The KW Elite Leadship Team does not review marketing materials UNLESS the agent specifically requests a review using KW Elite's Marketing Approval Request Form.
- This page satisfies OREC's required duty of the brokerage to notify & train agents on marketing requirements.
- The KW Elite Leadership Team reserves the right to disable any agent's non-compliant KWRI-provided technologies (eEdge websites, KW websites, eAgentC websites, KW Whitepages profiles, etc.) Your myKW account may be accessed (and your password changed in order to access your account) by the KW Elite Leadership Team in order to disable any KW technologies not compliant with OREC or KW Elite policies.
- An agent's failure to make any marketing effort compliant (printed, online, social, or otherwise) will result in release of his/her license from KW Elite.
- Agents may be required to pay ANY & ALL fines incurred by themselves, the brokerage, AND the broker due to failure to comply with these requirements.

LOGO & TEXT SIZING

- The KW Elite logo should be about 1/10th the height of tall media or 1/4th to 1/3rd the width of wide media. (See Print Media section.)
NOTE: For sizing purposes, the KW Elite logo includes both the capital KW ELITE and Keller Williams Realty line below it. - The office address and office phone number should be at minimum the same height (or larger) as the Keller Williams Realty line in the logo.
- The franchise disclaimer should be no less than half the height of the Keller Williams Realty line, and still large enough to be readable.
- All required brokerage info should be large enough to be read from a reasonable distance, or be similar in size to other surrounding text.
BROKERAGE & AGENT INFO PLACEMENT
- All four components of required brokerage info should appear in reasonable proximity to each other (See Ready-to-Use Compliance Images).
- Required brokerage info should be in reasonable proximity to agent’s information (directly below or same side, if possible)
COLORS FOR READABILITY
- Color of required brokerage info text & KW Elite logo should significantly contrast with the background so that all text remains visible/readable (e.g., do not use a red KW Elite logo on a red background, or gray text on a dark background).
- Required brokerage info text should be as dark or as light (or moreso) as the Keller Williams Realty line in the KW Elite logo.

- For tall media, the modern KW Elite logo should be about 1/10th the height of the design (large enough to be stacked about 10 times vertically across the design).
- For wide media, the modern KW Elite logo should be about 1/4th to 1/3rd the width of the design (large enough to be placed about 3 to 4 times horizontally across the width of the design).
- All required brokerage info should be readable at a reasonable distance, and fulfill the sizing proportions in the Required Info & Text Size section.
YARD SIGN 30% RED RULE
- KWRI requires all yard signs to include a minimum of 30% coverage of KW Red (Pantone 200) color.
TECH TIP: How to Check Logo Size & KW Red Coverage
You can place a 10x10 grid over the entire area of your design, then count the number of grid areas to check for logo width/height and KW Red coverage. The KW Elite logo should be as tall as one grid area for tall media (yard signs, flyers, etc.), or as wide as 3 to 4 grid areas for wide media (business cards, billboards, etc.). You could also stack the KW Elite logo 10 times vertically or about 3 to 4 times horizontally across the design to check for logo sizing.

Due to the wide variety of print media & tangible item shapes, these guidelines may need to be reasonably adjusted for marketing pieces that are exceptionally tall, wide, or oddly-shaped such as tall or wide banners, pens, car wraps, etc. Requests for a staff review of ANY design can be made at marketingapproval.kweliteokc.com.

Marketing vs. Paid-To Names
OREC'S MARKETING NAME VS. PAID-TO NAME POLICY
An agent may NOT get paid to the same (or similar) "business" name that they also market as,
and ANY marketing name an agent creates MUST be registered with OREC.
MARKETING NAMES
A Marketing Name is any name (other than your own personal name—e.g., Wes Kennedy, REALTOR®) that you publicly market your real estate business as (i.e., the "name" of your business). Any name you market your real estate business under (other than your own personal name) MUST be registered with OREC (requires a $100 registration fee).
You may purchase & use a domain name (e.g., HomeCo.com or SearchOKC.homes) to simply point to your website, and this would not be considered a Markeitng Name, UNLESS you specifically choose to use your domain name as your Marketing Name. AND if you choose to use your domain name as your Marketing Name, you will still need to register your domain name as your Marketing Name with OREC.
Any combination of names, words, domain names, LLC, Inc., etc. can be registered with OREC as a marketing name. For example...

- You MUST register ANY marketing name you create with OREC for $100
- Register your paid-to/LLC name with the Oklahoma Secretarary of State for (about) $100 first time, and a $25 year renewal fee.
- Finally, inform OREC of your OK SoS-registered paid-to/LLC name (there is no fee for this).

If you've NOT registered a business/LLC/corporation with the Oklahoma Secretare of State, and simply get paid in your own personal name & social security number (e.g., Wes Kennedy), you do not need to worry about the following.
If, however, you've registered a name (either your personal name or a "business" name) with the Oklahoma Secretary of State as an LLC, corporation, etc. and get paid to that name with a federal tax ID/EIN number, then you MUST adhere to the following policies, or you can be fined by OREC for a marketing/paid-to name violation.
If you've NOT registered a business/LLC/corporation with the Oklahoma Secretare of State, and simply get paid in your own personal name & social security number (e.g., Wes Kennedy), you do not need to worry about the following.
If, however, you've registered a name (either your personal name or a "business" name) with the Oklahoma Secretary of State as an LLC, corporation, etc. and get paid to that name with a federal tax ID/EIN number, then you MUST adhere to the following policies, or you can be fined by OREC for a marketing/paid-to name violation.
- Your Paid-To Name MAY be the same as your Marketing Name IF both your Marketing and Paid-To Names are based on or include your personal name (e.g., Wes Kennedy Real Estate and Wes Kennedy, LLC) since there is no confusion that your Marketing Name and Paid-to Name is YOU, the agent.
- Your Paid-To Name MAY "look like" a business name (e.g., HomeCo Realty) ONLY IF you DO NOT market under that same "business" name.
Please see a member of the KW Elite Leadership Team BEFORE choosing a Marketing Name to market your business under or registering a Paid-to/LLC with the Oklahoma Secretary of State.
This will prevent you from not only facing a fine from OREC, but also having to pay for new marketing materials (business cards, yard signs, etc.), or having to create new banking info, checks, communication to your accountant, etc.
ACCEPTBALE EXAMPLES
The examples to the right are acceptable because either (1) the Paid-to Name is based on a personal name, or (2) the Paid-to Name is a "business" name, but it is NOT also used in the marketing name.

Due to the the wide number of differences in social media profiles, the following requirements should be included to the fullest extent possible that the profile allows (e.g., inserting the office address and office phone number in a profile's About or Description field if the profile doesn't provide an Address or Work Phone Number field).

RECOMMENDATIONS
- Use your own phone number in any personal or cell phone number fields.
- Include the office phone number in any Office or Work Number fields, if possible.
- You should NOT include any references to Keller Williams or KW Elite in your profile name, business name, page title, and/or custom page URL. These can be difficult or impossible to change on some platforms, and all required compliance is taken care of in other areas of your profile info anyway.

For detailed guidelines on contests & give-aways, agents should refer the OREC License Code & Rules Handbook at OREC's website. However, in short, contests, give-aways, raffles, drawings, etc. are allowed as long as they DO NOT REQUIRE the purchase of a home.

- It is impossible to account for every potential marketing piece or social media outlet. The policies above are imperfect, and serve as CAUTIOUS GUIDELINES.
- Agents should NEVER stray from these guidelines on their own. Any time a Keller Williams Realty Elite agent feels an exception should be made to the guidelines above, they MUST present it to a member of the KW Elite leadership for approval. Thoughtful consideration will be given to all requests.
- In short, the intent of the guidelines presented here is that all of an agent’s marketing should make it clear that they are an agent with Keller Williams Realty Elite, and WHERE KW Elite can be contacted/found in case there is an issue with the agent's marketing.
